These Terms of Use ("Terms") govern your use of traceready.xyz and the TraceReady FSMA 204 Readiness Guide ("Site"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

Guide content is general, not legal advice

The FSMA 204 Readiness Guide and related content are general operator resources. They are not a legal, regulatory, or compliance opinion, and they do not account for the specific facts of your operation. Nothing on this Site constitutes legal advice. You should not rely solely on the guide to determine your regulatory obligations. For specific regulatory determinations, consult qualified legal counsel and review the text of the regulation at 21 CFR Part 1, Subpart S.

Use of the Site

Intellectual property

All Site content (text, graphics, logos, UI, code) is owned by TraceReady or its licensors and is protected by copyright and trademark law. You may view and share links to the Site. You may not reproduce, distribute, or create derivative works without our express written consent.

No warranties

The Site is provided "as is" and "as available" without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. While we work to keep the Site available and the content accurate, we do not guarantee uninterrupted access or error-free content.

Limitation of liability

To the maximum extent permitted by law, TraceReady and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of the Site, including regulatory actions, lost business, lost data, or lost profits. Our aggregate liability for any claim arising out of the Site is limited to $100 USD.

Paid engagements

Paid engagements (the 60-day TraceReady program) are governed by a separate Master Services Agreement and Statement of Work executed between TraceReady and the customer. In the event of conflict, those agreements control over these Terms for the subject matter they cover.

Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws provisions. Any dispute will be resolved in the state or federal courts located in King County, Washington.

Changes

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date at the top. Continued use of the Site after changes constitutes acceptance.
